Terms and Conditions

 

This Lease Agreement (the "Agreement") is made and entered into on the date of acceptance by the Renter, by and between **Chao Wilai at Phuket Co., Ltd.** (the "Owner") and the registered guest or renter (the "Renter").

By confirming the reservation, checking in, or occupying the property, the Renter acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.

Reservation & Cancellation Policy

 

• All reservations are **non-refundable** and **non-transferable**, unless otherwise stated in writing by the Owner.

• Any modification to reservation dates is subject to availability and the Owner's approval.

• Failure to arrive on the scheduled check-in date without prior notice may result in cancellation of the reservation without refund.

 

 

Check-in & Check-out

 

• Standard Check-in: From **3:00 PM**

• Standard Check-out: Before **11:00 AM**

 

 

Early check-in and late check-out are subject to availability and may incur additional charges.

Failure to vacate the property by the designated check-out time may result in additional charges, including an additional night's accommodation if applicable.

 

 

Security Deposit

 

A refundable security deposit of **THB 3,000** is required upon arrival.

The Owner reserves the right to deduct from the security deposit any costs arising from:

 

• Damage to the property

• Missing or stolen items

• Excessive cleaning

• Smoking violations

• Unauthorized guests

• Lost keys or access devices

• Any breach of these Terms and Conditions

 

The remaining balance of the security deposit will be refunded after inspection of the property.

 

 

Occupancy

 

• Only registered guests listed in the reservation may occupy the property.

• Overnight visitors who are not registered are prohibited unless approved in writing by the Owner.

• The maximum occupancy of the property must not be exceeded at any time.

• The Owner reserves the right to terminate the stay without refund if occupancy limits are exceeded.

 

House Rules

 

The Renter agrees to comply with the following rules:

• No smoking inside the property.

• No pets are permitted.

• No parties, events, or commercial activities.

• No illegal activities of any kind.

• No loud music or excessive noise.

• Respect neighboring residents and community regulations.

• Keep the property clean and in good condition.

• Do not remove any furniture, linens, towels, kitchen equipment, or other property from the premises.

• Children must be supervised by an adult at all times.

• Use all appliances and facilities responsibly.

• Quiet hours are observed between **10:00 PM and 8:00 AM**.

 

Smoking Policy

 

Smoking is strictly prohibited inside all indoor areas of the property.

Evidence of smoking indoors may result in additional cleaning and deodorizing charges, which may be deducted from the security deposit.

 

Damage to Property

 

The Renter is responsible for any loss or damage caused by themselves, members of their party, or visitors during their stay.

The Renter agrees to reimburse the Owner for repair or replacement costs exceeding the security deposit where applicable.

Any accidental damage should be reported immediately.

 

Lost Keys & Access Devices

 

Lost keys, access cards, gate remotes, or other access devices will incur replacement charges.

Lock replacement costs may also be charged where necessary for security reasons.

 

Cleaning

 

The property shall be left in a reasonably clean condition upon departure.

The Owner reserves the right to charge additional cleaning fees where excessive cleaning is required.

 

Utilities

 

Utilities are included or excluded according to the reservation confirmation.

For monthly or long-term stays, electricity, water, internet, or other utilities may be charged separately where stated in the rental agreement.

 

Swimming Pool & Common Areas

 

Guests use all facilities and common areas entirely at their own risk.

Children must be supervised by an adult at all times.

Glass containers are not permitted in pool areas.

Failure to comply with pool safety rules may result in removal from the facility.

 

Internet

 

Complimentary Wi-Fi is provided as a convenience.

The Owner does not guarantee uninterrupted internet service and shall not be liable for service interruptions beyond its reasonable control.

 

Parking

 

Parking is provided subject to availability.

Vehicles and their contents remain entirely at the owner's risk.

The Owner accepts no responsibility for theft, damage, or loss.

 

Maintenance & Access

 

The Owner reserves the right to enter the property at reasonable times for inspections, maintenance, repairs, or emergencies.

Where reasonably possible, advance notice will be provided.

 

Personal Property

 

The Owner is not responsible for any loss, theft, or damage to the Renter's personal belongings.

Guests are encouraged to secure valuables at all times.

 

Lost Property

 

Items left behind after departure will be retained for up to **30 days**, where reasonably practicable.

Return shipping and handling costs are the responsibility of the guest.

 

Tropical Environment

 

The property is located in a tropical environment.

Despite regular pest control, insects, ants, mosquitoes, geckos, and other wildlife may occasionally be present. Their presence shall not constitute grounds for refunds or compensation.

 

Force Majeure

 

The Owner shall not be liable for any cancellation, interruption, or inability to provide accommodation resulting from events beyond its reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, utility failures, labor disputes, or other force majeure events.

 

Liability

 

The Renter occupies the property entirely at their own risk.

To the fullest extent permitted by law, the Owner shall not be liable for:

• Personal injury

• Illness

• Loss or theft of personal belongings

• Vehicle damage

• Accidents occurring on the property

• Utility interruptions

• Internet outages

• Temporary unavailability of facilities due to maintenance or unforeseen circumstances

 

The Renter shall be responsible for the actions of all occupants and visitors associated with their reservation.

 

Right to Refuse Accommodation

 

The Owner reserves the right to refuse accommodation or immediately terminate the stay without refund where guests:

• Violate these Terms and Conditions;

• Engage in illegal activities;

• Cause excessive disturbance;

• Damage the property;

• Endanger staff, neighbors, or other guests; or

• Engage in abusive, threatening, or violent behavior.

 

CCTV

 

For the safety and security of guests and staff, CCTV may operate in public and common areas of the property.

No surveillance devices are installed inside guest accommodation or private areas.

 

Governing Law

 

This Agreement shall be governed by and interpreted in accordance with the laws of the Kingdom of Thailand.

Any dispute arising under or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts of Thailand.

 

Termination

 

This Agreement may be terminated immediately by the Owner if the Renter breaches any provision of these Terms and Conditions.

Upon termination, the Renter must immediately vacate the property.

The Owner may retain rental payments and apply the security deposit toward damages, unpaid charges, or other losses resulting from the breach.

 

Acceptance

 

By making a reservation, checking in, or occupying the property, the Renter confirms acceptance of these Terms and Conditions and agrees to comply with all policies set forth herein.
